These Terms & Conditions govern your use of our website (plantingbrand.com) and any services you purchase from us, including SEO, Local SEO, AI SEO, LinkedIn Lead Generation, Email Marketing, Outbound Calling, Website Design, and Shopify Store setup.

By using our website or purchasing our services, you agree to be bound by these Terms & Conditions. Please read them carefully.

1. Services

We provide digital marketing and web development services, including but not limited to:

  • Search Engine Optimization (Monthly SEO, Local SEO, AI SEO)
  • LinkedIn Lead Generation
  • Email Marketing & Outbound Calling
  • Website Design (WordPress, Wix, Shopify) and Shopify Store Setup
  • Social Media Marketing

Exact scope, deliverables, and timelines for each service are as described on our website or in your individual project agreement/invoice.

2. Payment Terms

Projects and services require 50% advance payment before work begins, and the remaining 50% is due upon completion of the project/deliverable, unless otherwise agreed in writing.

For monthly retainer services (SEO, Local SEO, AI SEO, Lead Generation, etc.), payment is due at the start of each billing cycle.

Payments may be made via Wise, Upwork (for clients onboarded through Upwork), or direct bank transfer.

Work will not commence, or may be paused, until the applicable advance/payment is received.

All prices listed on our website are subject to change without prior notice; however, confirmed orders will honor the price agreed at the time of purchase.

3. Revisions

Each service plan includes a specific number of revisions as stated on the respective plan/package at the time of purchase (e.g., “2 Revisions” as listed on our website).

Revision requests must be within the original project scope. Requests beyond the agreed scope or revision limit may incur additional charges.

Revisions must be requested within a reasonable time after delivery; delayed feedback may affect project timelines.

4. Delivery Timelines

Estimated delivery timelines are provided at the time of purchase or in your project agreement (e.g., “15 Days Delivery”).

Timelines are estimates and may vary based on scope changes, client responsiveness, or delays in receiving required information/access/content from the client.

We are not liable for delays caused by incomplete or late information provided by the client.

5. Ownership & Intellectual Property

Full ownership of the website, design, and content transfers to the client only after full and final payment has been received.

Until full payment is made, all work-in-progress, designs, code, and content remain the property of Planting Brand Infotech.

Once fully paid, the client owns the final deliverables (website, content, designs) created specifically for them.

We retain the right to showcase completed work (e.g., ST Painters-style case studies, portfolio, screenshots) for our own marketing and portfolio purposes, unless the client requests confidentiality in writing.

Any third-party tools, plugins, themes, stock images, or licenses used in the project remain subject to their own respective license terms.

6. Client Responsibilities

The client agrees to:

  • Provide timely access, information, content, and feedback required to complete the project.
  • Ensure any content/materials provided to us (logos, text, images) do not infringe on third-party rights.
  • Make payments as per the agreed schedule.

7. Refunds & Cancellations

Refunds and cancellations are governed by our separate Refund Policy, available on our website. By purchasing our services, you also agree to the terms outlined there.

8. Limitation of Liability

We strive to deliver high-quality SEO and marketing services; however, we do not guarantee specific rankings, traffic, leads, or sales results, as these depend on factors outside our control (search engine algorithms, market competition, ad platform policies, etc.).

We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

Our total liability for any claim related to our services shall not exceed the amount paid by the client for that specific service.

9. Termination

Either party may terminate ongoing/retainer services with prior written notice, as agreed at the time of engagement.

Any work completed and payments due up to the termination date remain payable.

We reserve the right to terminate services for non-payment, abusive behavior, or misuse of our services.

10. Confidentiality

We treat all client business information, credentials, and project data as confidential and use it solely for the purpose of delivering the agreed services.

11. Governing Law & Jurisdiction

These Terms & Conditions shall be governed primarily by the laws of India, with courts in Punjab, India having jurisdiction over any disputes. For clients based in the USA, applicable local consumer protection laws may also apply where legally required.

12. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
