Service Provider: [Devesh Tiwari], Independent Digital Marketing Contractor

1. Introduction

I provide digital marketing and related services as an independent contractor. My services may include SEO, local SEO, AEO, GEO, social media marketing, PPC advertising, website design and development, lead generation, LinkedIn outreach, email marketing, cold calling, Shopify development, and mobile app development.

This Refund & Cancellation Policy explains the conditions under which cancellations and refund requests are considered.

By purchasing my services, you acknowledge that you have read and agreed to this policy, subject to applicable law.

2. 48-Hour Cancellation Window

You may submit a written cancellation and refund request within 48 hours of making your initial payment.

A request made within this period does not automatically guarantee a full refund.

If work has not started, I will review the request and determine the refundable amount, taking into account any applicable payment processing charges, third-party costs, and other charges that may lawfully be deducted.

If work has already started, the value of work completed, research conducted, strategy prepared, resources committed, and other applicable costs may be deducted from the amount paid.

Any refund will be determined in accordance with the agreed scope of work and applicable law.

3. Services Once Work Has Started

Digital marketing services may require research, planning, account setup, technical implementation, content creation, outreach preparation, development, and other professional work.

Once work begins, fees attributable to services already performed are generally non-refundable, except where a refund or other remedy is required by law or expressly agreed in writing.

For projects involving multiple stages or milestones, the value of completed stages and work performed will be considered when calculating any amount due upon cancellation.

4. Non-Refundable Costs

Where applicable and legally permissible, the following costs may be excluded from a refund:

  • Work already completed or delivered.
  • Research, audits, strategy, planning, and consulting already provided.
  • Third-party advertising expenditure already incurred.
  • Approved purchases of software, tools, licenses, hosting, domains, or other project resources.
  • Other documented costs reasonably incurred for the client’s project.

I will not deduct costs that are prohibited by applicable law or charge for work that was neither performed nor properly incurred.

5. Monthly and Recurring Services

For monthly SEO, social media marketing, advertising management, or other recurring services, cancellation will normally take effect at the end of the current paid service period unless otherwise agreed.

Fees for services already provided during the current billing period are generally non-refundable, subject to applicable law and the specific service agreement.

Cancelling a recurring service will stop future billing where the applicable payment arrangement allows it. It does not automatically cancel outstanding invoices for services already provided.

6. Client-Initiated Delays and Non-Cooperation

Clients are responsible for providing accurate information, approvals, access credentials, materials, and feedback reasonably required to deliver the services.

If delays occur because the client fails to provide these items, project timelines may be extended. Such delays do not automatically entitle the client to a refund for work already completed or costs already incurred.

If the project cannot proceed, I may pause or terminate the engagement after providing reasonable notice. Any outstanding balance or potential refund will be assessed under the service agreement and applicable law.

7. Results and Performance

Digital marketing results depend on factors beyond my control, including search engine algorithms, competition, advertising platforms, market conditions, website history, budget, and client cooperation.

I do not guarantee specific rankings, traffic levels, leads, sales, revenue, or return on investment unless a particular commitment is expressly documented in a separate written agreement.

Failure to achieve an estimated or desired result does not, by itself, establish an entitlement to a refund. This does not exclude remedies available under applicable law for a failure to provide the agreed services.

8. How to Request a Refund

To request a cancellation or refund, email [Your Contact Email] with:

  • Your full name and contact details.
  • Invoice or transaction reference.
  • The service purchased.
  • The date of payment.
  • The reason for your request.

I will review the request and respond within a reasonable period. Approved refunds will normally be processed through the original payment method, where available, within 7–14 business days after approval. Bank, payment provider, or international transfer processing times may vary.

9. Exceptions and Legal Rights

Nothing in this policy is intended to waive, restrict, or exclude any consumer right, statutory remedy, or other protection that cannot legally be excluded or limited.

Where applicable law requires a refund, cancellation right, or other remedy, the relevant legal requirement will take precedence over this policy.
